Benami Property Law: What You Need to Know
Benami Property Transactions
The Benami Transactions (Prohibition) Amendment Act, 2016 gave the government powerful tools to crack down on properties held in others' names. Here is what every property buyer should understand.
What Is Benami
A benami transaction is one where property is held by one person but paid for by another, and the benefits are enjoyed by the person who paid. The legal owner (benamidar) is just a name on paper. The beneficial owner (the one who paid) is the actual controller.
Common Scenarios
Buying property in a relative's name to avoid taxes or hide assets. Using employees or associates as front owners for multiple properties. Purchasing in a minor child's name with undisclosed income. Using shell companies to hold property anonymously.
Penalties
The property can be confiscated by the government. Criminal prosecution with imprisonment up to 7 years. Fine up to 25% of the fair market value of the property. No appeal rights on confiscated property.
Legitimate Exceptions
Property held by a Hindu Undivided Family (HUF) for the benefit of members. Property held in trust or on behalf of a person who paid. Joint ownership where the sources of funds are disclosed. Always use legitimate ownership structures when buying from Infratyke.
