Bank Auction Properties

When borrowers default on home loans, banks auction the property under the SARFAESI Act. These auctions can offer properties at 20-30% below market value, but they come with specific risks.

Where to Find Them

Bank websites (most list auction properties under "e-auctions"). IBAPI (Indian Banks Auctions Properties Information) portal. Newspaper public notices (legally required before auction). Some banks have dedicated portals (SBI e-auction, HDFC auction).

The Process

Register on the bank's e-auction platform. Submit EMD (Earnest Money Deposit, typically 10-25% of reserve price). Bid during the auction window (usually 1-2 hours). If you win, pay 25% within 24 hours and the balance within 15-30 days. The bank executes a sale certificate (not a sale deed).

Risks

The previous owner may be in physical possession (eviction can take months via court). Title issues if the borrower disputes the bank's right to sell. Pending utility bills and society dues from the defaulter. The property condition may be poor (no pre-auction inspection in many cases).

Due Diligence

Verify the bank's legal right to auction (check if SARFAESI process was followed correctly). Search for any pending litigation on the property. Inspect the property physically if possible. Factor in eviction costs and time if the property is occupied. For regular market options, browse Infratyke.
