Succession Certificate vs Legal Heir Certificate: When You Need Which
Inheritance Documents Explained
When a property owner dies, heirs need specific legal documents to claim the property. The right document depends on whether there is a will and what type of property is involved.
Legal Heir Certificate
Issued by the tehsildar or municipal authority. Lists all legal heirs of the deceased. Used for: claiming insurance, provident fund, bank deposits, and as a supporting document in property matters. Simpler and faster to obtain (2-4 weeks). Does not by itself transfer property ownership.
Succession Certificate
Issued by a civil court. Establishes who can inherit specific debts and securities of the deceased. More comprehensive legal document. Takes 3-6 months to obtain. Required when there is no will and movable property (bank accounts, shares) needs to be transferred.
Probate
Required when there IS a will and the property is in certain cities (Mumbai, Kolkata, Chennai, and Delhi in some cases). Court-certified validation of the will. Establishes the executor's authority to distribute assets per the will. Can take 6-18 months.
For Property Transfer
Mutation of property in revenue records requires: death certificate, legal heir certificate, and either the will or a family settlement deed signed by all heirs. If there are disputes among heirs, a civil suit for partition may be necessary. Get legal advice before attempting property transfer.
